Application of Terms and conditions 

The purpose of these general conditions of sale is to define the rights and obligations between Sabily Collection and the consumer, applying without restriction or reservation to all sales of products appearing on the website www.sabilycollection.com. Confirming an order implies full and complete acceptance of these terms and conditions. Each customer also acknowledges having full legal capacity in order to be able to commit to it.

Prices are expressed in euros (€) and US dollars ($) and do not include taxes or shipping costs. Sabily Collection reserves the right to modify its prices at any time, depending on economic or regulatory conditions, but we undertake to apply the prices in force which will have been indicated to you at the time of your order.

The price indicated in the order confirmation is the final price with shipping costs. However, it does not include any customs or other taxes.

All orders are invoiced and payable in euros (€) or US Dollars ($). For any delivery in Metropolitan France or internationally, any customs charges or local taxes remain the responsibility of the recipient.

3-Product information

4-Payment

Payment of the full price is due immediately on the date of the order. At no time can the sums paid be considered as a deposit or down payment. The full amount of the order will be collected by Sabily Collection when the order is dispatched. All orders are payable in Euros (€) or US dollars ($).

5-Delivery

Products purchased on the sabilycollection.com site can only be delivered to the geographic areas we serve. The times indicated are usual average times and correspond to processing and delivery times. The products are delivered to the address indicated by the customer during the ordering process. Sabily Collection cannot be held responsible for the consequences due to a delay in delivery. In case of delay, an email is sent to the customer.

In the case of payment by credit card, the times indicated above run from the day the payment is registered and correspond to the processing and delivery times.

In the event of payment by check or bank transfer, the order is only processed upon receipt of the check or transfer. Consequently, the deadlines applicable in this case are those on the day of receipt of payment and can therefore be modified compared to those mentioned on the day of placing the order.

6-Delivery issues 

All products leave our warehouse in perfect condition. The customer must notify the carrier (or the postman) of the slightest trace of impact (holes, traces of crushing, etc.) on the package, and if necessary refuse the package. A new identical product will then be returned to you free of charge.

The exchange of any product declared, a posteriori, damaged during transport, without any reservation having been made upon receipt of the package, cannot be taken care of.

As with any shipment, it is possible to experience a delay or for the product to go astray. In such a case, we contract the carrier to initiate an investigation. Every effort is made, as long as necessary, to find the package.  Sabily Collection decline all responsibility for loss of the package by the carrier. After the investigation if the carrier declares the package lost and pays compensation, the amount thereof will be returned to the customer as compensation.

We decline any responsibility for the extension of delivery times due to the carrier, in particular in the event of loss of products, bad weather, customs seizure, confiscation by customs for X reason and strike. Any anomaly concerning the delivery (damage, product missing from the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of a “ handwritten reserve ”, accompanied by the signature of the customer.

The consumer must at the same time confirm this anomaly by sending the carrier within two working days of the delivery date a registered letter with acknowledgment of receipt setting out the said complaints.

The consumer must send a copy of this letter.

In the event of loss of Parcel / Envelope:
All of our Parcels / Envelopes are shipped with a tracking number. For international shipping if the package / envelope is not delivered within 30 days from the date of dispatch, we will contact TNT express or Aramex customer service to initiate a parcel tracing investigation. In Malaysia, the investigation is initiated within 7 days of the date of filing the complaint.
If as a result of the investigation the envelope / parcel is finally lost, we accept no responsibility and we will not refund the amount of your order because the parcels / envelopes are sent without insurance.

7-Delivery errors

The consumer must formulate with customer service, the same day of delivery or at the latest the first working day following delivery, any claim of error of delivery and / or non-conformity of the products in kind or in quality compared to to the information on the order form.

Beyond this period, any complaint will be rejected. The formulation of this complaint with customer service can be made at the email address [email protected]

Any complaint not made in accordance with the rules defined above and within the time limits cannot be taken into account and will release Sabily Collection from any liability towards the consumer.

In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned after having informed customer service within 7 working days, as a whole and in its original packaging in impeccable condition.

To be accepted, any return must be reported and have the prior consent of customer service, which if agreed will reship the package to the correct address.

The shipping costs are the responsibility of Sabily Collection, except in the event that the product does not correspond to the original declaration made by the consumer in the correct return direction.

8-Satisfied or refunded

The right of withdrawal only applies to natural persons.

The consumer has a period of seven (7) calendar days to return, at his expense, products that do not suit him (excluding products on promotion). This period runs from the day of receipt of the consumer’s order. Any return must be reported in advance to Sabily Collection customer service. Please contact us by email before returning the merchandise.

Only products returned as a whole, in their original packaging, complete and intact, and in perfect condition for resale will be accepted. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded, returned or exchanged. This right of withdrawal is exercised without penalty, with the exception of shipping and return costs which will be borne by the customer.

In the event that the right of withdrawal is exercised, the consumer has the choice of requesting either the reimbursement of the sums paid or the exchange of the product. In the case of an exchange, the reshipment will be at the expense of the consumer.

9-Confidentiality

12- Returns

In the event of a technical anomaly in the product or an error in the reference delivered, the customer will follow the product return procedure described below. The costs and risks of return are always the responsibility of the customer. Only a voucher of the value of the Colissimo package in force on the site in Metropolitan France or the value of the package in force in the customer’s country of delivery, will be produced by Sabily Collection, if the products delivered do not correspond to the references ordered. . In case of refusal of parcel delivery by the customer, the customer will be responsible for all shipping costs incurred for the dispatch of their order, as well as FedEx return fees, potential customs fees, and any other charges, such as fees incurred by a third party authorized to retrieve the parcel from the FedEx warehouse if necessary. It is important to note that if the parcel is destroyed by FedEx or customs, no refund can be claimed by the customer. The shipping costs borne by the customer after the refusal of the parcel are the basic FedEx Express shipping charges, excluding any reduction due to the total amount of the order.

The refund for the order will be processed after the successful receipt of the parcel and verification that the product is in perfect condition for resale, deducting the total shipping and return fees mentioned earlier. Furthermore, we reserve the right to apply restocking fees of up to 30% of the product’s price if the customer returns the entire order or a portion thereof without a valid reason attributable to an error on our part, a product defect, or damage.
